"Colossus" is the name for a computer program that insurance companies use to evaluate and assign settlement value to auto accident personal injury claims.
The program works by using data previously entered regarding the nature of an accident, the type of injuries, the medical bills, and other factors to compare a case to other similar scenarios in its database. The program considers what those cases settles for and uses its own internal calculation to arrive at a settlement value range for a particular case.
It is important to understand that while insurance carriers can use tools to evaluate claims they receive, an attorney should be able to gauge the value of the case personally based on the personal story involved in the case (who was at fault, but more importantly, WHY they were at fault), as well as objective factors considered by Colossus and the adjuster.
Let’s expand on that point. Ultimately if the case goes to trial, a jury of your peers will be deciding what compensation you receive as a result of a personal injury auto accident claim. Members of the jury will listen to all of the facts, treatment and other damages. But that is not the whole story regarding any case. Negligence which gives rise to an auto accident claim is best conveyed to the jury in the form of a story. Who is the hero? Who is the villain? What could have been done to prevent this accident, but was not? How can a jury properly award damages in order to prevent this from happening again? These are the things an attorney will consider in preparing the case. Insurance companies know that an attorney can affect the value of the case and will take that into account.
